Srinagar, Jun 24: A local court here has awarded two-year simple imprisonment to a man in a cheque bounce case of Rs 5.5 lacs. It has also directed the accused to pay a compensation amount of Rs.11.00 lacs which is double the cheque amount.

While convicting the accused person, F A Dar of Anantnag, Court Of Judge Small Causes Fayaz Ahmad Qureshi awarded sentence of simple imprisonment of two years for the commission of offence U/S 138 read with 142 N.I.Act.
“Accordingly, the accused is convicted and sentenced to a simple imprisonment of two years. Besides, the accused person shall pay a compensation amount of Rs.11.00 Lacs (Eleven Lakhs only) which is double the cheque of Rs 5.50 Lacs,” the court said in the order, a copy of which is with GNS, adding, “The accused is directed to pay the compensation amount of Rs.11.00 Lacs to the complainant within a period of one month from the date of this judgment failing which the same shall be recovered in accordance with Section 421 Cr.PC and other provisions of law applicable.”

The court asked Superintendent of Central Jail, Srinagar to lodge the convict in Central Jail, Srinagar until he completes the sentence of two years and on completion of the sentence, subject to any order as may be passed in case of any appeal, the convict shall be released.

“However, the sentence shall remain suspended for a period of seven days from the date of this judgment to enable the accused to prefer an appeal which he is intending to,” the court said, adding, “However, if no appeal is filed or no order is passed staying this judgment, the Superintendent Central Jail Srinagar shall, on expiry of seven days i.e. upto 30/06/2022, commit the convict to jail for serving sentence.” The complaint leading to conviction of the accused and subsequent sentencing was filed by one Mahinder Pal Singh of Pulwama through advocate Abrar Ahmad.
