Shopian, Aug 19: A local Court in Shopian has convicted and sentenced an accused in a cheque bounce case for two years imprisonment and directed him to pay double cheque amount to the complainant with 15 percent interest on the cheque amount from date of issuance of cheque till realisation of cheque in practical.

An official told the news agency—Kashmir News Observer (KNO) that Manzoor Ahmad Khanday son of Lassi Khanday resident of Barbugh Shopian had taken different items including cardboard boxes, pesticides and fertilizers from a dealer namely Shabir Ahmad Rather son of Gh Mohammad Rather resident of Hillow, Shopian.

He said that Manzoor was owing around Rs 98 lakh to Shabir and Manzoor gave a cheque of Rs 70 lakh to Shabir with date 25 April 2021, however, cheque got bounced.

“On 25 May 2021 brought memo of the cheque following which legal notice was issued to the accused and he was asked to pay the amount or legal action may be initiated against you. However, the accused neither paid the amount nor replied to the notice following which case was proceeded before Chief Judicial Magistrate Shopian,” he said.

“Later the accused appeared before the court and started contesting the case and after several hearings, the CJM Shopian convicted the accused for knowingly giving fraud cheque to the dealer when he was aware there is no money in his account,” he added.

“The accused was accordingly convicted with an imprisonment for a term of two years, double the amount of cheque that is Rs 1.40 crore as fine, 15 percent interest on cheque amount from the issuance of cheque till realisation of cheque in practical and litigation charges of Rs 50,000 to the compliant,” he added.

Officials said that cheque fraud cases are on rise and it is message and warning for all people who are doing fraud—(KNO)
